Slowly, states are lessening limits on marijuana

LOS ANGELES -- James Gray once saw himself as a drug warrior, a former federal prosecutor and county judge who sent people to prison for dealing pot and other drug offenses. Gradually, though, he became convinced that the ban on marijuana was making it more accessible to young people, not less.

"I ask kids all the time, and they'll tell you it is easier to get marijuana than a six-pack of beer because that is controlled by the government," he said, noting that drug dealers don't ask for IDs or honor minimum age requirements.

So Gray -- who spent two decades as a superior court judge in Orange County, Calif., and once ran for Congress as a Republican-- switched sides in the war on drugs, becoming an advocate for legalizing marijuana.

"Let's face reality," he says. "Taxing and regulating marijuana will make it less available to children than it is today."

A recent brouhaha between Starbucks Coffee and marijuana legalization advocates raises an important question for the broader business community: Can major national companies be successful absent the patronage of marijuana consumers and others who support marijuana policy reform?

Not too long ago, it was absolutely necessary for businesses to maintain an appearance of opposition to marijuana use and legalization. But the times they are a-changin', and it is beginning to seem like many major companies are striving to maintain an appearance of NOT opposing marijuana use and legalization.

LA City motion to put taxing cultivation on the 2011 Citywide ballot

A motion by Councilmember Hahn, seconded by Councilmember Koretz moves that the City Attorney, with assistance of the City Administrative Officer, prepare and present the necessary documents to place on a Citywide ballot in 2011 a tax on the cultivation of medical marijuana.

California Supreme Court Invalidates State Limits on Medical Marijuana Possession

A quick note from OU Staff:
Please keep in mind that any amount of medicinal cannabis grown or possessed must be reasonable for the patient's condition and medical needs.  What "reasonable" is will have to be determined on a case-by-case basis in the court of law.  We will pass on more information after we have fully vetted this issue with our legal advisers.

The Justices Unanimously Declare Unconstitutional a 2003 Provision
That Capped Possession at Eight Ounces and Cultivation at Six Mature
or 12 Immature Plants.

In a unanimous decision filed Thursday, the California Supreme Court
struck down the state's specific limits on how much medical marijuana
a patient can possess, concluding that restrictions imposed by the
Legislature were an unconstitutional amendment of a voter-approved initiative.

The decision, which affirmed an appellate decision, means people who
have a doctor's recommendation to use marijuana can possess and
cultivate as much as is "reasonably necessary."
